Privacy Notice for Applicants in the United Kingdom and European Economic Area

The protection of your personal data is important to us. Your data is protected in accordance with statutory requirements (in particular, EU General Data Protection Regulation [GDPR] for candidates in the European Economic Area, the UK GDPR for candidates in the UK, the German Data Protection Act [BDSG] for candidates residing in Germany, and any other local data protection laws that apply to you).

1. Contact details of the Controller and data protection officer

Responsible for the collection of your personal data during the application process is the Sauce Labs entity to whom you are applying for a job. A list of our operating affiliates and their addresses is available from datenschutz@saucelabs.com.

2. Data processing during the application procedure

When you apply for employment at Sauce Labs, the following personal data may be collected as part of your job application:

  • Full name, date of birth, address, telephone number, email address, photograph, and information on your qualifications, professional experience, LinkedIn profile, salary expectations, education or training and, if applicable, hobbies and leisure activities. We also collect any other information you voluntarily submit to us as part of your application.

  • Any notes, and internal communications related to your job application and any interviews we conduct with you.

  • Personal data pertaining to special categories, such as voluntarily provided data regarding your health (e.g. information pertaining to disabilities), per, e.g., Article 6(1)(b), Article 9(1) GDPR (in Germany Article 88 GDPR, s. 26(3)(1) BDSG).

Your personal data will be processed for the purposes of managing recruitment related activities, which include setting up and conducting interviews and tests for applicants, evaluating and assessing the results thereto, and as is otherwise needed for recruitment and hiring-related processes. We require personal data from you to evaluate your application and such processing is legally permissible under Article 6(1)(b) of GDPR as necessary for the performance of the solicitation, evaluation, and selection of applicants for employment or services relationships at the Sauce Labs (in Germany s. 26 (1) BDSG). Note: Based on your consent, your application may also be considered for Sauce Labs locations other than the location specific to where you applied.

If you apply to us via your online profile on Linkedin, you grant us access to your profile so that we can read it. We will then only collect the information we need from it for our applicant profile. Please note, however, that the read permission you grant us also allows us to see further information from your professional contacts and, if applicable, your life. On LinkedIn, your profile will usually also show the last visitors. Therefore, other users may also learn about our contacts. If we extend an offer to you, we may request and collect additional information from you, such as proof of eligibility to work in the country in which you would work (e.g., a passport or visa), tax information, bank account information, benefits eligibility information and other information. We use these categories of information to take steps to enter into a work contract with you per Article 6(1)(b) of the GDPR. Should your application be accepted, your personal information may be subject to additional privacy notices.

We may also use your personal information to comply with applicable laws and administer our compliance with such requirements (such as under immigration and data protection laws) per Art. 6(1)(c) of the GDPR. In the event of a proposed merger, acquisition, sale or other business transaction involving our business or its assets, we may use your personal data in ways that support or give effect to the transaction per Art. 6(1)(f) of the GDPR, and your personal data will not be subject to any less protection during or after the transaction.

3. Duration of data storage

Should your job application be rejected, Sauce Labs shall store your application data for a maximum period or six months upon the rejection of your application, unless you consent to a longer period of storage, or the storage is required as per legal or statutory requirements.

Your personal data will be retained by Controller as long as Controller determines it is necessary to evaluate your application for employment.

4. Recipients of personal data

Within the scope of processing, your personal data shall not be transmitted to any recipients other than the entity you applied for.

In certain cases, we may have to pass on part of your data that we process as part of the application process to places and persons outside our company. Classified according to categories, we pass on data to the following groups of recipients:

  • Our associated companies within the Group only with your consent

  • Service providers who process personal data (so-called processors)

  • If applicable, lawyers who work for us

Should we be legally obliged to pass on your data or if your data are necessary for our lawyers, personnel consultants and personnel brokers to conduct their work, we will pass on your data to them to the extent required.

Service providers who work on our behalf process some data for us. Should this be the case, we conclude a so-called order processing contract with the service provider by means of which we require the service provider to process the data carefully and in accordance with our instructions. This ensures that the service providers process the data in accordance with our specifications and on our behalf. For the application management, we specifically use the software solution of the provider Greenhouse Software, Inc., New York (USA). In addition, only the employees of our company who must view your data within the framework of the application procedure shall have access to your personal data, in particular the HR department and the decision-makers in the respective department, who must also co-decide on your recruitment and therefore must view your data.

5. Your rights with regard to data processing

Your rights with regard to data processing are based on the conditions set forth under applicable laws. You have the right to access information and copies of your personal data (Article 15 GDPR), as well as correction (Article 16 GDPR) or deletion (Article 17 GDPR) of your personal data. You also have the right to data portability (Article 20 GDPR). Furthermore, you may demand the restriction of data processing (Article 18 GDPR) and object to the processing (Article 21 GDPR) of your personal data, in which case we will only process your personal data for certain purposes or stop processing your personal data, if certain conditions apply. You have the right not to be subject to a decision based exclusively on automated processing (Article 22 GDPR).

6. Revocation of consent

Insofar as the collection or processing of your personal data is based on consent, you may revoke your consent at any time with effect for the future. The legality of the processing carried out until the revocation shall remain unaffected in the event of revocation.

7. Right of appeal to a supervisory authority

You shall have the right to appeal to the competent supervisory authority. You may also contact the data protection authority at your place of residence, which will then forward your request to the competent authority. Sauce Labs - Canadian Candidate Privacy Notice

  • Other Sauce Labs companies: We may share your personal information with other companies in the Sauce Labs group to ensure that any decision made with respect to your application reflects the input of all appropriate internal stakeholders and takes into account the internal forecasting, planning and other interests of all relevant Sauce Labs group companies. 

  • Third-party service providers and professional advisors: We may make your personal information available to service providers, such as IT services providers, and external advisors, such as lawyers, personnel consultants and personnel brokers. These recipients may be located in the U.S. 

  • Corporate Restructuring: In the event of a merger, reorganization, dissolution or similar corporate event, or the sale of all or substantially all of our assets, we expect that the information that we have collected, including your personal information, will be transferred to the surviving entity in a merger or the acquiring entity. 

We implement confidentiality and privacy agreements and take other steps intended to ensure that recipients of your personal information provide a level of protection comparable to the level of protection accorded by Canadian privacy laws. Some of the above noted entities may be located outside of Canada, and as such, where your personal information is transferred to jurisdictions outside of Canada, it will be subject to the legal regime of that country.

4. What rights do you have with respect to your personal information?

Under applicable privacy laws, you may have rights to access and correct the personal information we hold about you. You also have the right to withdraw your consent so that we no longer process personal information in ways that you previously consented to. Withdrawing your consent to the processing of your personal information may impact your ability to advance in the application process. Even if you withdraw your consent to the collection, use or disclosure of personal information, we may still keep that personal information if we are permitted or required to do so by law.
