SUPPLEMENTAL CALIFORNIA CONSUMER PRIVACY ACT (“CCPA”) PRIVACY POLICY

In this Supplemental California Consumer Privacy Act Privacy Policy (“CCPA Privacy Policy”), we, Sauce Labs Inc, disclose information about our data processing practices with respect to California residents in our capacity as a business under the California Consumer Privacy Act of 2018 (“CCPA”) and supplement the disclosures in our other privacy notices. This CCPA Privacy Policy is effective January 1, 2023. For purposes of this CCPA Privacy Policy, the term “personal information” has the meaning given in the CCPA but does not include information exempted from the scope of the CCPA.  In some cases, we may provide a different privacy notice to certain categories of California residents, such as job applicants, in which case that notice will apply instead of this CCPA Privacy Policy.

1. Your California Privacy Rights

California residents have the rights listed below under the CCPA. However, these rights are not absolute, and in certain cases we may decline your request as permitted by law. 

  • Information.  You can request the following information about how we have collected and used your personal information during the past 12 months:

    • The categories of personal information that we have collected.

    • The categories of sources from which we collected personal information.

    • The business or commercial purpose for collecting and/or selling personal information.

    • The categories of third parties with which we share personal information.

    • The categories of personal information that we sold or disclosed for a business purpose.

    • The categories of third parties to whom the personal information was sold or disclosed for a business purpose.

  • Access.  You can request a copy of the personal information that we have collected about you during the past 12 months. 

  • Correction. You can ask us to correct inaccurate personal information that we have collected about you.

  • Deletion.  You can ask us to delete the personal information that we have collected from you.

  • Opt-out of “sharing” for targeted advertising purposes. You can opt-out of certain sharing of personal information for targeted advertising purposes.

  • Nondiscrimination.  You are entitled to exercise the rights described above free from discrimination as prohibited by the CCPA.  

Verification of Identity; Authorized agents. We may need to verify your identity to process your requests to know, access, appeal, correct, or delete information we have collected about you, and we reserve the right to confirm your residency. To verify your identity, we may require government identification, a declaration under penalty of perjury, or other information, where permitted by law.  

Under some state privacy laws, you may enable an authorized agent to make a request on your behalf.  However, we may need to verify your authorized agent’s identity and authority to act on your behalf.  We may require a copy of a valid power of attorney given to your authorized agent pursuant to applicable law. If you have not provided your agent with such a power of attorney, we may ask you to take additional steps permitted by law to verify that your request is authorized, such as by providing your agent with written and signed permission to exercise your State Privacy Laws rights on your behalf, the information we request to verify your identity, and confirmation that you have given the authorized agent permission to submit the request. 

We describe here the personal information that we generally collect, use, disclose and sell about California residents. You have the right to request that we disclose what personal information we collect, use, disclose and sell about you specifically (“right to know”). To submit a request to exercise the right to know, please visit our privacy request webform. Please specify in your request the details you would like to know, including any specific pieces of personal information you would like to access.

We will ask that you provide certain information to verify your identity, generally through a confirmation link sent to an email address we may have on file for you. If you have a password-protected account with us, we may verify your identity through our existing authentication practices for your account. The information that we ask you to provide to verify your identity will depend on your prior interactions with us and the sensitivity of the personal information at issue. We will respond to your request in accordance with the CCPA. If we deny your request, we will explain why.

To communicate with you in relation to your account; to: (i) create an account for you in order to use our products and services; (ii) manage the account; (iii) fulfil your orders for our products and services; and (iv) provide you with customer service and technical assistance; to respond to any specific comments or questions you may have; to (i) provide, maintain, monitor, secure, debug, customize and optimize our products and services; and (ii) develop and improve our products and services; to supplement the other personal information we hold about you in support of our sales and marketing activities; to manage and secure our events; to perform our obligations and exercise our rights under our Terms of Service or any other agreement relating to our products and services that you conclude with us; to perform activities necessary to ensure compliance with applicable national, state, provincial and other applicable laws, and to respond to requests from government authorities; to protect the legal interests, health or safety of a user, us, or other third parties, such as in the event of a complaint or dispute, or to perform credit recovery procedures or credit assignments to authorized third parties; as permitted by applicable law, including with your consent where required, we may use your contact information to provide you with marketing communications, promotional offers and updates on new products and services; in the event that we, or some or all assets related to our business are acquired by or merged with a third-party entity or in connection with a merger, acquisition, sale, or other change of control, we may transfer some or all of the personal information that we have collected about you to another organization as part of that transaction. If we intend to transfer your personal information in connection with such a transaction, we may proceed with notice to you, grant you an opportunity to object, or seek your consent, as permitted or required by applicable law.

5. Exercising Your Right to Opt-Out of the “Sale” or “Sharing” of Personal Information

While we do not sell personal information for money, however, like many companies we may use digital ad networks or other digital advertising technology services that help deliver interest-based ads. The CCPA may classify our use of some of these services as “selling” or “sharing” your Personal Information with the advertising partners that provide the services.  California residents can submit requests to opt-out of tracking for targeted advertising purposes or other sales of Personal Information by navigating to “Cookie Settings” at the bottom of our site.
